These Terms and Conditions (“Terms”) govern your access to and use of SaferNewport.com and the online simulators and related pages operated by the Newport Beach Police Association (“NBPA,” “we,” “us,” or “our”) (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site is provided for informational and educational purposes only. It presents analysis and modeling regarding the location of a Newport Beach police headquarters, compiled from public records, published reporting, statements made in open public meetings, and publicly available data. The Site reflects the views and advocacy positions of the Newport Beach Police Association.
The Site is not affiliated with, endorsed by, or an official publication of the City of Newport Beach or the Newport Beach Police Department. References to public officials, public meetings, and public records are presented for public information.
The simulators produce modeled estimates. They use third-party routing over public road-network data and publicly available calls-for-service information to estimate travel times under stated assumptions. They do not reflect actual computer-aided dispatch records, actual unit availability, or actual historical response times.
In an emergency, call 911. Never use the Site to obtain or attempt to obtain emergency assistance.
The Site is not directed to children under 13. By using the Site you agree that you will not:
Certain features ask for your name, email address, and optionally a mobile phone number. You agree that any information you submit is accurate and that you have the right to provide it. Your submission and our handling of that information are governed by our Privacy Policy, which is incorporated into these Terms by reference. Text message consent is optional, is never a condition of using the Site, and may be withdrawn at any time as described in the Privacy Policy.
The Site and its content, including text, analysis, graphics, layout, and software, are owned by NBPA or its licensors and are protected by applicable intellectual property laws. The NBPA name and logo are the property of the Newport Beach Police Association and may not be used without permission.
You may view, download, and print Site content for personal, non-commercial, informational use, and you may quote or cite the Site with attribution. All other rights are reserved.
Certain materials reproduced on the Site, including public records, photographs, and excerpts of published reporting, remain the property of their respective owners and are presented for public information and commentary.
The Site relies on third-party services to function, including OpenStreetMap and the OSRM routing service, Esri and OpenStreetMap basemap tiles, Google Fonts, and the City of Newport Beach’s public calls-for-service data feed. The Site may also link to third-party websites. We do not control and are not responsible for the content, accuracy, availability, terms, or privacy practices of any third party. Your use of third-party services is subject to their own terms.
We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We do not warrant that the Site will be available, uninterrupted, timely, secure, or error free, and we may update content, figures, and methodology as new public information becomes available.
THE SITE AND ALL CONTENT AND SIMULATOR OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR ITS CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR FREE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NBPA AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, VOLUNTEERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless NBPA and its officers, directors, members, employees, volunteers, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the jurisdiction of those courts.
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, are the entire agreement between you and NBPA regarding the Site. Our failure to enforce any provision is not a waiver of it.
We may update these Terms from time to time. Changes are effective when posted, and the “Effective date” above will be updated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
